These Terms of Use govern your access to and use of the Neravil platform, including all content, features, tools, and services available at neravil.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must discontinue use immediately.

1. Acceptance of Terms

By creating an account, accessing any portion of the platform, or completing any activity on Neravil, you enter into a legally binding agreement with Neravil. These Terms of Use apply to all users, including visitors, registered learners, instructors, and any other individuals who interact with the platform in any capacity.

We reserve the right to update or modify these terms at any time. Continued use of the platform after changes are published constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.

2. Eligibility

To use the platform, you must be at least 16 years of age. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these terms on your behalf. We do not knowingly collect information from children under 13 years of age. 3. User Accounts

3.1 Registration

Each user may hold only one account. Creating multiple accounts for the purpose of circumventing restrictions, obtaining unfair advantages, or any other reason is prohibited.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party. Any activity that occurs under your account is your responsibility, whether or not it was authorized by you. If you suspect unauthorized access to your account, notify us immediately at support@neravil.com.

3.3 Account Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion, including but not limited to cases of violation of these terms, fraudulent activity, or conduct that is harmful to other users or the platform. You may also request account deletion at any time by contacting our support team.

4. Platform Content and Intellectual Property

4.1 Ownership

All content available on the platform, including but not limited to text, graphics, quiz questions, educational materials, course structures, software, interface designs, logos, and audiovisual elements, is owned by or licensed to Neravil and is protected by applicable intellectual property laws. Nothing in these terms transfers any ownership rights to you.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial educational purposes. This license does not permit you to reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit any platform content without prior written permission from Neravil.

4.3 User-Generated Content

If the platform allows you to submit content such as answers, comments, or forum posts, you retain ownership of that content. However, by submitting it, you grant Neravil a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the platform. You represent that you hold all necessary rights to submit such content and that it does not infringe on any third-party rights.

5. Prohibited Conduct

You agree not to use the platform in any manner that:

Violates any applicable law or regulation
Infringes upon the intellectual property rights or privacy of others
Involves unauthorized access, reverse engineering, scraping, or data mining of any part of the platform
Introduces malicious code, viruses, or any disruptive technology
Involves cheating, using unauthorized aids, or otherwise manipulating quiz or test results
Involves impersonating another person or entity
Involves transmitting unsolicited communications or spam
Attempts to interfere with the proper functioning of the platform or its servers
Involves collecting or harvesting personal data of other users without consent
Is intended to harass, threaten, or harm any individual or group

We reserve the right to investigate any suspected violation and to take appropriate action, including removal of content, suspension of access, and referral to relevant authorities.

6. Quizzes, Tests, and Academic Integrity

The platform is designed to support genuine learning and honest self-assessment. You agree to complete all quizzes and assessments independently and without using unauthorized resources, unless explicitly permitted by the activity instructions. Sharing quiz content, answers, or result data with others outside of the platform's intended sharing features is strictly prohibited. Violations of academic integrity may result in account suspension and forfeiture of any progress or certifications associated with your account.

7. Fees and Payments

7.1 Paid Services

Certain features or content on the platform may require payment. All applicable fees will be clearly disclosed before you complete a purchase. By completing a payment, you authorize us to charge the stated amount using your selected payment method. All amounts are displayed inclusive of applicable charges unless stated otherwise.

7.2 Refunds

Refund eligibility is determined on a case-by-case basis and subject to our current refund policy, which is available upon request. Digital content that has been accessed or partially consumed may not be eligible for a full refund. We are not obligated to provide refunds for changes in your personal circumstances, scheduling conflicts, or dissatisfaction with content if you have already accessed a substantial portion of the material.

7.3 Price Changes

We reserve the right to modify our pricing at any time. Changes will not affect transactions already completed. Advance notice of price changes will be provided where practicable.

8. Third-Party Links and Services

10.2 Platform Availability

We do not guarantee uninterrupted or error-free access to the platform. The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not responsible for any loss resulting from platform downtime, technical errors, or data loss.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Neravil and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of the platform, even if advised of the possibility of such damages.

In no event shall our total cumulative liability to you for all claims arising under or in connection with these terms exceed the greater of the amount you paid to us in the twelve months preceding the claim or one hundred US dollars (USD 100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Neravil and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way related to your access to or use of the platform, your violation of these terms, your submission of any content, or your infringement of any third-party rights.

13. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation. We may also impose limits on certain features or restrict access to parts of the platform without notice or liability.

14. Governing Terms and Dispute Resolution

These terms are governed by general principles of international commercial law and the widely accepted standards applicable to software-as-a-service platforms. In the event of a dispute arising from or relating to these terms or your use of the platform, both parties agree to first attempt to resolve the matter through good-faith negotiation by contacting support@neravil.com. If a resolution cannot be reached informally within thirty days, the dispute may be referred to binding arbitration in accordance with internationally recognized arbitration rules. You agree to waive the right to participate in class-action proceedings in connection with any such dispute.

15. Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Use, together with the Privacy Policy and any other policies or notices published on the platform, constitute the entire agreement between you and Neravil with respect to your use of the platform. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to the platform.

17. Waiver

The failure of Neravil to enforce any right or provision under these terms shall not be considered a waiver of that right or provision. A waiver is only effective if made in writing and signed by an authorized representative of Neravil.
